Regulation of cryptocurrencies in Hong Kong: VASP license
Hong Kong's Securities and Futures Commission (SFC) has announced the implementation of a licensing system for Virtual Asset Service Providers (VASP) starting June 1, 2023. Given the novelty of the regulation, it is expected that the licensing process may take up to a year.
The VASP license allows for the provision of storage and exchange services for virtual assets, such as cryptocurrencies. However, it's important to note that the license does not cover operations with fiat currencies, limited-purpose digital tokens, securities, and futures. Additionally, NFTs are not classified as virtual assets under this license.
It's worth noting that Hong Kong will no longer allow virtual asset exchanges to serve retail investors. Regardless of the type of license, operators will only be able to offer their services to professional investors.
The process of obtaining a VASP license requires compliance with several conditions:

- Management and owners undergo a Fit and Proper test.
- A significant share capital must be maintained.
- A physical office in Hong Kong is mandatory.
