It is important to note that none of these licenses allow working with currency pairs involving the Kenyan shilling or offering binary options.

Requirements for Obtaining a License

To obtain a FOREX license in Kenya, a company must meet a number of strict requirements:

  • Presence of a local LLC-type company and an office in Kenya
  • Qualified personnel, including a CFO, compliance officer, and internal auditor
  • A board of directors of at least three people, including an independent chairman
  • Minimum charter capital from 92,000 to 455,000 USD depending on the type of license
  • Compliance with capital and liquidity requirements

Taxation and Permitted Assets

Non-resident companies with a permanent establishment in Kenya are taxed at 37.5% of net income. Licensed FOREX brokers are allowed to work with a wide range of assets, including currency pairs, securities, indices, futures, and CFDs.
