Vanuatu imposes strict regulations on crypto companies
The parliament of the island nation of Vanuatu has passed a new law requiring all virtual asset service providers to obtain a license from the Vanuatu Financial Services Commission (VFSC). These providers include cryptocurrency exchanges, NFT trading platforms, digital asset custody services, and initial coin offering (ICO) companies. In addition to licensing, these organizations are required to regularly report to the regulator.
Compliance with international standards and penalties
According to the VFSC, the main objective of the law is to bring the country's financial sector in line with international anti-money laundering (AML) and counter-terrorism financing (CFT) standards. The regulator has the power to initiate investigations into suspicious crypto companies and, in case of violations, impose severe penalties: fines can reach 250 million vatu (approximately $2 million), while serious offenses can lead to imprisonment for up to 30 years.
It is worth noting that the new law does not apply to stablecoins, tokenized securities and central bank digital currencies (CBDCs), despite their similarity to virtual assets. VFSC emphasized that before the adoption of the law, a multi-year study was conducted on the risks associated with digital assets and their integration into the local financial system.
Vanuatu's previous cryptocurrency initiatives
Despite its modest size, Vanuatu is not the first time at the center of cryptocurrency initiatives. Previously, the republic became famous for being the first in the world to accept bitcoins in exchange for citizenship. And in 2022, a British crypto investor acquired an uninhabited island of the archipelago with an ambitious idea of creating a crypto-focused community - the so-called "crypto utopia".
According to VFSC, the introduction of regulation will not only limit the activities of dubious players, but also expand access to financial services for local residents. It will also simplify international payments using cryptocurrencies, making Vanuatu's financial system more modern and open to innovation.
