Adoption of the Law in the Sejm

Poland is taking a confident step toward harmonizing its legislation with pan-European regulations governing the crypto industry. The lower house of parliament, the Sejm, has approved the draft Law on the Crypto-Assets Market, which will serve as the basis for the implementation of the MiCA (Markets in Crypto-Assets) regulation in the country. This document aims to establish transparent rules for cryptocurrency companies, as well as enhance investor protection and market stability.

According to official information, the bill has been submitted to the Senate, where it will undergo further consideration. After any amendments, the document is expected to receive the signature of the President of Poland, which will mark the final stage of the legislative process.

Transition Period for VASPs

Of particular note is the extension of the transition (trial) period for existing virtual asset service providers (VASPs). According to the new bill, the transition period is extended until July 1, 2026. This means that existing crypto providers will be able to continue operating under current regulations for almost a year and a half before fully transitioning to MiCA requirements.

This step will allow companies to adapt to new regulatory requirements, including future licensing and reporting standards for Crypto-Asset Service Providers (CASPs).

Prospects and Expectations

Despite progress, the situation remains dynamic. The bill may undergo changes during discussions in the Senate. Furthermore, the European Commission and local regulators are expected to provide further clarification on several MiCA provisions.

Final approval and entry into force of all regulations is expected by the end of 2025, making 2024–2025 crucial for preparing crypto businesses in Poland for the new regulatory environment.
